At FXH, LLC (FXH), we recognize that your privacy is important. This Privacy Policy (the “Privacy Policy”) discloses the privacy related practices of FXH for the FXHNYC.COM website (the “Site”), provision of FXH products and services (collectively referred to as the “Services”) and discloses the ways in which personal and other information that we receive or collect about you is collected and treated.
You acknowledge that this Privacy Policy is designed to be read in connection with the Site Terms of Use Agreement, which is available at https://www.fxhnyc.com/terms-of-service, and that by accessing or using our Site, you agree to be bound by the Site’s Terms of Use Agreement, as well as this Privacy Policy.
We reserve the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account (if applicable), by placing a prominent notice on our site, and by updating any information on this page. Your continued use of the Site and or Services after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) your agreement to abide, be bound by the Privacy Policy, and subject to the privacy related practices as modified.

1. Personal Information That May Be Collected. In order to better provide you with a better customer experience, we may collect the following types of information;
(a) Personally Identifiable Information: This refers to information that lets us know the specifics of who you are. When you engage in certain activities on this Site, such as registering for an account, purchasing a product, submitting content and/or posting content, or sending us feedback, we may ask you to provide certain information about yourself. Examples of Personally Identifiable Information may include your first and last name, email address, mailing address, telephone numbers, and other identifying information. When ordering products on the Site, you may be asked to provide a credit card number and/or other personal credit or personal financial information to complete the transaction.
(b) Aggregate Information: This refers to information that does not by itself identify a specific individual. (c) Service Quality Monitoring. Some site transactions may require you to telephone FXH, or FXH to call you. FXH will not contact you by telephone without your prior consent, except to confirm an order placed online, address payment related issues, address shipping related issues, and/or to inform you of the status of any such order or special circumstances that require FXH to contact you. You should be aware that it is FXH practice to monitor, and in some cases record such calls for staff training or quality assurance purposes.
(d) Information from Children. FXH does not intentionally collect or maintain information from users actually known to be under the age of 18, and no part of the FXH Site is intentionally structured to attract anyone under the age of 18.
3. Uses Made of the Information
(a) General Use. Without your prior consent, but always subject to the uses described in this Privacy Policy, FXH will not use your personal identifiable information for any purpose other than that for which it is submitted.
(b) Marketing Uses. The information you provide to FXH may be collected, used, analyzed and/or processed by FXH, or selected third parties on FXH behalf, for marketing and other business purposes.
(c) Stored Information Uses. FXH may store and retain the information provided by you. This information is used to compile your purchase history in order to enable FXH to recommend products, services, or special offers that would be of interest to you; to support your interaction with the Site; to deliver your purchases; and/or to contact you again about other FXH services and products.
(d) Online Advertising. Some companies that help FXH deliver interactive on-line advertising, such as banner ads, may collect and use information about FXH customers to help FXH better understand the types of advertising or promotions that are most appealing to FXH customers. After it is collected the information is aggregated so it is not identifiable to a specific individual.

4. Disclosure of the Information
(a) Within Corporate Organization. FXH may, only as reasonably necessary, for operational purposes, share your personal information within the FXH corporate organization and with legal, insurance, financial and other professional advisors to FXH. It is FXH practice to seek appropriate protection for information in these types of relationships and to reasonably limit disclosure to the greatest extent.
(b) FXH Business Development and Growth-Related Circumstance. Circumstances may arise where for business reasons, FXH decides to sell, buy, merge, expand, recapitalize, or otherwise reorganize its business in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to third-parties. It is FXH practice to seek appropriate protection for information in these types of transactions and to reasonably limit disclosure to the greatest extent.
(c) Agents. FXH may employ or engage other companies and individuals to perform business functions on behalf of FXH. These companies or persons may be provided with personal identifying information required to perform their functions but will be contractually prohibited from using the information for other purposes. These persons engage in a variety of functions which include, but are not limited to, fulfilling orders, delivering packages, removing repetitive information from customer lists, analyzing data, providing marketing assistance, processing credit card payments and providing customer services. It is FXH practice to seek appropriate protection for information in these types of transactions and to reasonably limit disclosure to the greatest extent.
(d) Affiliated Businesses. FXH may work closely with a third-party affiliated business providing services or selling products on each other's web sites. Your information may be shared with any such affiliated business. It is FXH practice to seek appropriate protection for information in these types of transactions and to reasonably limit disclosure to the greatest extent.
(e) Other Site Practices. The Site may contain links to other web sites. FXH is not responsible for the privacy practices or the content of those other web sites.
(f) Marketing Analysis by Third Parties. FXH reserves the right to disclose to third-parties personal information about customers for marketing analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual customer.
(g) Disclosure to Governmental Authorities. Under certain circumstances, personal information may be subject to disclosure pursuant to a judicial or other government subpoenas, warrants or orders.
5. Use of Computer Tracking Technologies.
(a) No Tracking of Personal Information. The FXH Site is not designed or configured to track, collect or distribute personal information not submitted by you. However, through web site access logs FXH does collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our sites. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which provides better services to our customer. The statistics garnered, which contain no personal information and cannot be used to gather such information, may also be provided to third-parties.
(b) Use of Cookies. FXH, or its third-party vendors, collects non-identifiable and personal information through the use of various technologies, including "cookies". A cookie is an alphanumeric identifier that a web site can transfer to a user or customer's hard drive through the user or customer's browser. FXH cookies do not generate personal data, do not read personal data from your machine and are never tied to anything that could be used to identify you. The cookie is then stored on customer's computer as an anonymous tag that identifies the customer's computer, but not the customer. Cookies may be sent by FXH or its third-party vendors. Customer can set its browser to notify customer before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customer may also set its browser to turn off cookies; however, some web sites may not then work properly.
(c) Use of Web Beacon Technologies. FXH may also use web beacon or other technologies to better tailor its Site to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the Site, a non-identifiable notice of that visit is generated which may be processed by FXH. Web beacons usually work in conjunction with cookies. If customer does not want cookie information to be associated with customer's visits to these pages, customer can set its browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.
(d) Collection of Non-Identifiable Information. FXH may collect non-identifiable information from user visits to the FXH Site in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on FXH Web site(s); Site and system administration; user analysis; and business decision making. Such information is sometimes known as "clickstream data." FXH or its contractors may use this data to analyze trends and statistics.
(e) Collection of Personal Information. FXH collects personal identifying information from customer during a transaction. FXH may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help FXH understand trends and patterns. This information is not reviewed at an individual level.
6. Information Security
(a) Commitment to Online Security. FXH employs physical, electronic and managerial procedures to safeguard the security and integrity of personal information. Billing and payment data is encrypted whenever transmitted or received online. Personal information is accessible only by staff designated to handle online requests or complaints. In order to most effectively serve you, credit card transactions and order fulfillment are handled by established third party banking institutions and processing agents. They receive the information needed to verify and authorize your credit card or other payment information and to process and ship your order.
(b) No Liability for Acts of Third Parties. FXH uses third-party programs, applications, code, software, services, and hardware provided, administered, and maintained by third-party service providers in the operation of its business. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personally Identifiable Information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed. FXH will exercise all reasonable efforts to safeguard the confidentiality of your personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, FXH shall not be liable for unauthorized disclosure of personal information due to no fault of FXH including, but not limited to, errors in transmission and unauthorized acts of FXH staff and/or third parties.
(c) Phishing. "Phishing" is a scam designed to steal your personal information. If you receive an email that looks like it is from us asking you for your personal information, do not respond. We will never request your password, user name, credit card information or other personal information through email.
(d) Lost or Stolen Information. If your credit card and/or password is lost or stolen, you should promptly notify FXH in order to enable FXH to cancel the lost or stolen information and to update its records with a changed credit card and/or password.
7. Privacy Policy Changes and Opt-Out Rights
(a) Changes to Privacy Policy. This privacy notice was last updated on August 01, 2019. FXH reserves the right to change its privacy policy statement at any time for any reason.
(b) Opt-Out Right. You have the right at any time to cease permitting personal information to be collected, used or disclosed by FXH and/or by any third parties with whom FXH has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting FXH via e-mail privacy@fxhnyc.com. After processing the cancellation, FXH will promptly delete your personal information from its data base.
8. Access Rights to Your Data
(a) Information Maintained by FXH. Upon your request, FXH will promptly provide a reasonable description of your personally identifiable information that FXH maintains in its data bank. FXH can be contacted by e-mail at privacy@fxhnyc.com.
(b) Corrections and Changes to Personal Information. Help FXH to keep your personal information accurate. If your personal information changes, or if you notes an error upon review of your information that FXH has on file, please promptly e-mail FXH by email at privacy@fxhnyc.com and provide the new or correct information.
9. Accountability
Terms of Use. If you choose to visit the FXH Site and/or make purchases of Services, your action is hereby deemed acceptance of this Privacy Policy and FXH practices described in this policy statement. Any dispute over privacy between you and FXH is subject to the provisions of this notice and to FXH's Terms of Use Agreement which is hereby incorporated herein and which can be read at https://www.fxhnyc.com/terms-of-service.
